Early Times Report Jammu, February 22 IN a two LPAs filed by Johnny William, S Parminder Singh, Surinder Kumar and Shafqat Ali Battali, all presently SSPs, challenged the retrospective benefit to promotees 27 private respondents and seeking setting aside the judgment of Single Judge, Division Bench of J&K High Court Jammu Wing comprising Chief Justice Barin Ghosh and Justice GH. Hasnain Massodi after hearing Advocate Abhinav Sharma, Sr. Advocate Sunil Sethi with Adv Veenu Gupta appearing for the appellants whereas Additional Advocate General Mr. Jagdish Parihar appeared for the State and Adv Jatinder Choudhary also appeared for the respondents, directed state of J&K to file specific response within a period of four weeks.
Directing the state and other respondents, Division Bench observed that the subject matter of challenge in the petition was Govt order dated May 17, 2000 whereby promotions were accorded with effect from February 27, 1981, October 7, 1981, June 28, 1983 and December 1, 1984 . Promotions given by the said order were justified on the basis of the order passed by a Division Bench of State on November 20, 1998 and not interfered by the Supreme Court of India. The order of the Division Bench dated November 28, 1998 would ample makes it clear that the challenge thrown therein, which succeeded pertained to selections made on December 17, 1971, June 5, 1972, July 23, 1971, State has not explained how the judgment so rendered by the Division Bench had or has any nexus with the orders dated May 17, 2000, which were impugned in the petition and also how the date of promotion of the various candidates had been fixed as February 27, 1981, October 7, 1981, June 28, 1983 and December 1, 1984, DB want a specific response by the state in that record and directed the state to file such response within a period of four weeks.
