| Court orders respondent to demolish construction on petitioner’s plot | | | EARLY TIMES REPORT Jammu, Feb 23: Sub-Judge, Jammu, Mohd Rafiq Chak has ordered Raj Kumar of Talab Tillo, Jammu and others to demolish the construction raised over the plot of the petitioner at Talab Tillo measuring five marlas and asked Incharge P/S Nowabad that he shall personally monitor the demolition over the plot after thoroughly verifying the same. Court also fined Rs 10,000 to respondent and the amount of fine shall be paid to the petitioner. In case, the respondent default in payment of fine he shall be sent to civil prison for a period of thirty days.
Taking serious note of the attitude of the respondent, Sub-Judge, Jammu Mr M R Chak after hearing Adv SK Puri apparing for the petitioner observed that respondent Raj Kumar had hijacked the whole process of law and in utter defiance of the order passed by this Court construction was raised. The act of the respondent has been highly contemptuous and in case it is over looked, it will certainly place premium on his contemptuous act and in view of the provisions the respondent is fined Rs 10,000 and the amount of fine shall be paid to the petitioner.
This significant order passed by the Court in a suit filed by one Shashi Devi seeking permanent prohibitory injunction against Raj Kumar, the respondents was restrained by the Court. Despite the Court direction, respondent raised the construction on the plot of the petitioner. JNF
