| HC kept in abeyance prosecution of then DSP and SHO women cell | | Anara case: | | EARLY TIMES REPORT Jammu, Feb 23: Justice Hakim Imtiyaz Hussain of J&K High Court in a petition filed by Tanveer Jeelani, then SDPO, Bakshi Nagar, issued notice to Financial Commissioner, Home, DGP J&K and SSP Crime Branch, Jammu and after hearing Adv PN Raina for the petitioner ordered that impugned notification November 27, 2009 SRO 369 dated November 27, 2009 SRO 369 shall remain in abeyance.
According to the notification, on October 24, 2004 a police party led by Inspector Kiran Bala then SHO Women’s Cell Jammu took Mrs. Raj Rani, her daughter Anara Gupta and her son Kumar Sambhav to the P/S Women Cell Jammu and kept them along with other two minor sons who were also picked up around noon on the same day in police custody till November 3, 2004 when a case was registered against Anara Gupta under FIR NO 25/2004 u/s 292/93 of RPC r/w section 7 of Cinematography Act and section 6 and 7 of the IT ACT.
After being released from the police custody, the mother of Anara Gupta, Mrs. Raj Rani filed a complaint before the NHRC against the police alleging wrongful confinement, torture and having been forced to make confession which was forwarded to the DGP for inquiry for registration of a case. FIR No 07/2005 u/s 34, 344 RPC registered in the Crime Branch, Jammu and accorded sanction for prosecution of Mr. Tanveer Jellani DySP then SDPO Bakshi Nagar and Kiran Bala then SHO P/S Women Cell Jammu. This notification was challenged by Tanveer Jeellani on various grounds, seeking stay on the operation of said notification. JNF
