| Consumer Commission grants 11 lacs compensation to a student cheated by respondent | | | Early Times Report Jammu, February-24 (JNF):- The State Consumer Commission comprising Justice GDarma (rtd), its President and BL Saraf Sessions Judge (rtd), its member at Jammu in a complaint filed by Siddant Dubey, a student, who was allegedly cheated by a CEO, Corporate Wings and Aviation technology New-Delhi, has allowed the complaint and grant of relief of Special Damage claimed by a Complainant Rs 1, 08, 000/- with interest 9% per annum from the date of filling complaint till realization.
Besides, the complainant is entitled to the compensation of 10 lakh for the loss of one academic year as also loss of one precious year of his life. The Commission also awarded Rs 5000/- as litigation expenses.
In the complaint, the complainant submitted that he is student and has been duped and defrauded by respondent Capt JK Dogra. CEO Corporate Wings and Aviation technology c/o Plot No 4 Sector 10, opposite Golak Dham Temple New Delhi by offering him attractive and lucrative career of a commercial pilot. By false representations and allurements, admission fee and tuition fee in sum of Rs 96000 was extracted from the complainant. When complainant become aware of the malafide intention, he served notice. The notice had some statutory effect as an amount of Rs 25000 was remitted back to him on March 22, 2009.
In the approved for reporting judgment written by Justice GDarma for the commission after hearing Adv Pankaj Dubey appearing for the complainant observed that registered notice of the complaint was given and served upon the respondent who failed to enter appearance and file the written version. The complainant tendered his evidence on affidavit. In ex-parte manner, and supported the averment made in the complaint. Since the allegations made in the complaint go un-rebutted, so it held without any manner of doubt that complainant has succeeded in proving his case. The commission is viewing such unfair trade & practice with all serious concern. It is hoped and trusted that the Govt of India will take notice under the relevant law and take action against respondent so that other students like the complainant are saved from being duped, cheated and suffer in their career prospects. With these observations Commission allowed the complaint and granted special damage claim relief and compensation along with litigation expenses to the 11, 13, 000/- JNF
