| Amandeep murder: | | HC issues notice to SIT in bail plea filed by then SHO Gandhi Nagar | | Early Times Report Jammu: In a bail application filed Sultan Mehmood Mirza, the thenO P/S Gandhi Nagar, Jammu, presently lodged in the jail for allegedly involved in fudging evidence in much publicised murder case of Amandeep Singh, Justice JP Singh of J&K High Court Jammu Wing after hearing Adv Monika Kohli appeared for the petitioner issued notice to State through Special Investigation Team P/S Gandhi Nagar, Jammu with the direction to registry, list in week following the next week.
In the bail petition, it has been submitted that in the Challan and even supplementary challan, the alleged original weapon of offence was recovered at the instance of Choudhary Nagar Singh upon disclosure made by him. The petitioner is in custody since September 27, 2009 and had to take care of his two minor children and his wife who are undergoing irreparable damage. The younger brother of the petitioner died on December 26, 2009, the father of the petitioner has been killed by the militants and in the absence of petitioner, there is none to take care of his family. Even otherwise after the SIT having submitted their report in terms of Section 173 CrPC in the Sessions Court, the offence imputed against the petitioner remain to be u/s 409/210 RPC r/w section 3/25 of Arms Act and section 120-B of RPC. As per the challan submitted in the Court, no offence has been made out against the petitioner and petitioner is entitled to grant bail. JNF
