| Acquittal in dowry death case | | | early times report Jammu, Mar 1: Principal Sessions Judge, Jammu, BL Bhat acquitted one Chuni Lal alias Bitta r/o Makwal facing trial in abetment to suicide in which the wife of the accused Swarna Devi committed suicide on November 7, 2004. Principal Sessions Judge Jammu BL Bhat after hearing counsels and gone through the police case and statement of the witnesses and observed that the accused suspected that deceased was a patient of TB but on check-up it was found that the deceased was a heart patient and was treated from Dr. Mohan Lal. It is significant that prosecution witness Rakesh Dewan claims to have visited the deceased barely one month before her death and enquired about her health and expressed satisfaction with her treatment and stated that there was no problem. Therefore, in absence of any complaint regarding ill-treatment, having been made by deceased during her life-time and the admitted position that marriage was dowry less with further assertion made by one of the witness that the accused had refused to accept dowry claiming that the dowry of her first wife was intact. The court said that it was safe to conclude that the allegations regarding harassment of deceased related to dowry were not well founded and deceased had died due to massive heart attack as she was suffering from heart ailment, evidence regarding the deceased having consumed some poisonous substance and version given by one Kanta Devi cousin of the deceased that the deceased was heard to have been found having some tablets in her mouth is based on hearsay and pure conjectures. With these observations ,Court dismissed the challan and acquitted the accused from the charges leveled against him. ----JNF
