| HC imposes cost upon Farooq, others | | Election Petition challenging election of RS | | EARLY TIMES REPORT Jammu, Mar 3: The State High Court today imposed on imposed on Farooq Abdullah, Union Minister, Mohd Shafi Uri MP Rajya Sabha, Election Commission of India through its Secretary New-Delhi and Chairman Rajya Sabha New-Delhi for setting-aside the ex-parte proceedings initiated against them subject to payment of cost Rs 2000 each to be paid to Advocate HC Jalmeria appearing for the petitioner. The direction has come in a election petition filed by Harsh Dev Singh MLA, Leader of Panthers Legislature Party challenging the notifications issued by the election commission of India whereby it has been decided to hold bi-annual election for Rajya Sabha. Justice Sunil Hali of J&K High Court Jammu Wing imposed cost in three CMPs in which the application was filed by the respondents seeking condonation of delay in filling application for setting-aside the ex-parte order dated August 21, 2009. At this stage Advocate HC Jalmeria appeared for the petitioner stated that he has no objection in setting-aside the ex-parte proceedings initiated against respondents subject to payment of cost. Justice Sunil Hali allowed the applications and ex-parte proceedings initiated against the respondents ordered set-aside subject to payment of cost of Rs 2000 to be paid to advocate Jalmeria. The counsel for the petitioners HC Jalmeria pointed out that under similar circumstances where the terms of three members of council of states from Kerala is going to expired on April 21, 2009, the election commission of India vide similar notification has decided to hold a single biannual election for filling up three seats from the state of Kerala. It is submitted that such an act on the part of election commission of India is highly discriminatory and in violation of fundamental principles of democracy. ---JNF
