| Bail plea of narcotic smuggler dismissed | | | EARLY TIMES REPORT
Ramban, Mar 4: Principal Sessions Judge, Ramban, Ms Bala Joyti today rejected the bail application of one Charan Dass who was allegedly caught by the Chander Kot Police on February 19, 2010 and recovered poppy straw weighing 2.250 kg from his possession which he had hide in the cabin of a truck which was coming from Srinagar to Jammu and a case u/s 8/15 NDPS Act was registered against the accused and accused was arrested. While rejecting the bail application of the accused, Principal Sessions Judge Ramban Ms Bala Joyti after hearing all sides observed that investigation is at its infancy. According to prosecution statements of material witnesses are yet to be recorded. F.S.L report is awaited. Court is not satisfied at all that applicant/accused has made out his claim for grant of bail in light of aforesaid. Liberal approach in the matter of bails under NDPS Act is uncalled for and moreover, the contraband recovered from the possession of the accused person weighing 2.250 Kg. does not fall within the category of 'smaller quantity' as asserted by counsel for the applicant as such, in light of supra prayer of the applicant/ accused is declined. With these observations, the Court dismissed the bail application. ------JNF
