Amendment in JK Hindu Adoption Act sought

Jammu, Mar 5: Secretary, Damodhar Satri Udyog Sanstha(DSUS), Mrs Sunita Chandra, has urged Chief Minister Omar Abdullah to introduce amendments in the Jammu and Kashmir Hindu Adoption and Maintenance Act 1960 to allow childless couples to adopt abandoned/orphan children.
In a memorandum submitted to the Chief Minister and Law Affairs Minister of the state, Damodhar Satri Udyog Sanstha has stated, "there is no law which permits adoption of these orphan or abandoned children by those living in Jammu and Kashmir and outside the state". In a memorandum, she urged the Chief Minister to look into the matter afresh and introduce an amendment during the ongoing Assembly session, in the existing law so as to allow citizens of Jammu and Kashmir and those living outside the State to legally adopt abandoned /orphan children".
She said that large number of childless couples have even filed petitions in the court of law seeking permission to adopt such orphans / abandoned children but since amendment to section 9 (4) of Central Hindu adoption and Maintenance Act, 1956 incorporated in the year 1962, has not been made applicable to the state of Jammu and Kashmir debarring such couples to come forward and rehabilitate needy children.
She said that the existing central law was not applicable to the state of Jammu and Kashmir. The memoradum further stated that the State was reeling under turmoil and battling scourge of militancy for over two decades, has an estimated number of 1 lakh orphan children. Majority of these children are either rehabilitated in various orphanages across the state or living with their close relatives after the death of their parents.
Large number of such orphans or abandoned children face many hardships in the absence of basic amenities in life and has no voice of their own as they are living in oblivion, it further stated.
As per survey conducted by the International organization, UNICEF, even these orphans / abandoned children are deprived of their basic fundamental rights and due to scarcity of resources are not regularly visiting schools or even enrolled in formal school education.
Damodhar Satri Udyog Sanstha is presently running a project PAHL-- an initiative to impart education to street and under privileged children. Pressently, 110 students are enrolled under Project PAHL- where teachers are conducting classes on elementary education, teaching social etiquettes, cleanliness, hygiene, using modern teaching aids including audio-video medium. Most these children are under 10 year's age and they are not enrolled in Government Schools.
Project PAHL is a first of its kind initiative in entire Jammu and Kashmir State, where majority of school children are from our State and naxal hit districts of Chattisgarh, Bihar and UP being imparted elementary education under one roof.
