Bureaucrats add bung to promoted JE's rung
‘Nothing wrong with promotion order’

Jammu, Mar 7: The recently promoted junior engineers have accused some bureaucrats of marring their career to safeguard the interests of their kith and kin through overt and covert means.
A delegation of the junior engineers (Mechanical) told Early Times that the promotion order which saw their elevation to Assistant Engineers after two decades of service had been kept in abeyance.
Accusing the government of succumbing to the pressure of what they called unscrupulous elements in the bureaucracy, the delegation said , "The junior engineers(mechanical) recently promoted as Assistant engineers vide Govt. order no:- PW (R&B)101 dated - 3-3-2010 have rendered 22 years of service as junior Engineers . Normally diploma holders get a single promotion in their career. The said promotion order was issued after the government found them eligible for the said promotion as per the service rules."
They have become eligible for the said promotion as Assistant engineers when the posts of Assistant Engineers became available in 2009 by virtue of promotion of Assistant Engineers to Assistant Executive Engineers. The government initiated the process and ultimately promoted 36 junior engineers on March 3.
Before the promotion order was issued, the degree holders challenged the process in the high court and also managed to get a stay. The stay order, however, was vacated when the court heard the respondents. Accordingly the government issued the promotion order. The promoted junior engineers celebrated their promotion and even distributed sweets. They also joined their new assignments. But, the government had to keep the promotion order in abeyance as some bureaucrats launched a campaign against the order.
The delegation said the concern of the degree holders was totally unfounded. They cited a Supreme Court judgement of 2009 wherein the apex court has held: "It is entirely for the authorities to decide whether the degree holders and diploma holders should be treated at par or not for the purpose of promotion from the post of junior engineer to the post of assistant engineer."
The rules are also clear in this regard. The engineering cadre consists of BE and diploma holders in the promotion of JEs to AE which are in the ratio of 60% for the degree holders 20% for direct Quota and 20% for the diploma holders as per the recruitment rules. The rules provide in notification dated Sept 14, 2006 SRO 297 the provision for the promotion from Junior Engineers to Assistant Engineers irrespective of degree/diploma from the available eligible officers .the eligibility criteria for diploma holders is 5 years and for degree holders is 3years who have worked as junior engineers.
Since 90 posts of assistant engineers were lying vacant government ordered the promotion of 35 junior engineers (Mech) to the Assistant engineers vide Govt. order no 101 PW(R&B) dated 3-3-2010, leaving behind 55 vacant posts reserved for others becoming eligible in future. Though these posts could have been given to the rest of diploma holders who are eligible and have also service of 2 decades. An unnecessary hue and cry was raised by the ineligible officers of the degree cadre at the behest of some bureaucrats in the civil secretariat, through print media to sabotage the move which was purely done on justice and as per the rules.
The practice of promoting of officers from one source to another when the officer from the other cadre is not available is in vogue from the very past. Last year 36 officers from degree cadre were promoted as Assistant Executive engineers against the posts meant for Diploma cadre as the officers from the diploma cadre were not eligible at that time. The diploma cadre never raised a hue and cry as the authorities had done it as per the rules.
The delegation urged the government to put the promotion order into operation. "Let the government do justice. Let it not succumb to the pressure of some bureaucrats", the delegation appealed.
