| PIL regarding Patnitop Development | | DB Asked Chief Secretary to ensure no public/group meetings allowed at Patnitop | | Jammu, October, 12:- As per the direction of the Division Bench Comprising Chief Justice BA Khan and Justice Mansoor Ahmed Mir in PIL regarding Patnitop Development Registrar Judicial High Court Jammu wing Mr. DK Kapoor today issued Show-Cause notice to Mr. KK Gupta Chief Executive Officer Patnitop Development Authority to take notice and show cause why you should not proceeded against for DISOBEDIENCE OF THE ORDER OF THE COURT and for prima-facie for obstructing the course of implementation of the orders of the Court. Your reply must reach this registry within two weeks positively.
The Chief Secretary of J&K Govt, who was directed by the order of the Court on October 3, 2006 to put in place some supervisory mechanism to oversee the working of the Patnitop Development Authority and also to look into the circumstances in which public meeting by some political parties was allowed to be held at the hill-resort, the Chief Secretary is required to submit a report to the Court and is further ensure that no public meeting or any group meeting or use of loud-speakers is allowed at the Patnitop Hill-Resort. Report should reach this registry within two weeks positively.
This directions and notices were issued by the Registrar Judicial Mr. DK Kapoor as per the direction of the DB on the report of Sr. Advocate DC Raina, who was appointed Court Commissioner, has submitted in his report that he was disturbed to seek public meetings being held by a political party on the hill-resort and a number of vehicles parked on the road had congested the free-flow of the traffic and loud-speakers on the top due to which the entire environment of the area had been polluted by the noise emitted through the loud-speakers. Upon this the DB took serious note and directed Registry to issue show-cause notice to CEO Patnitop Development Authority. |
