| HC orders reinstatement of army cop | | | Early Times Report Jammu, Mar 16: Justice Sunil Hali of J&K High Court Jammu in a petition filed by one Sanjay Kumar, army cop who remained absent from duty and was discharged from service on March 31, 2005 on the basis of 7 red ink entries, allowed the petition after six years and set-aside the order of discharge and directed respondent to reinstate the petitioner with all consequential benefits. In the petition it was submitted that the petitioner was married against the wishes of parents and on account of family discord, he had rush to his home on several occasions as a result of which red ink entries were recorded in his service book. On the other hand the stand of the respondent that after having got more than six red entries in the service book and undergone rigorous imprisonment for several times, the petitioner has been discharged from service under the army rules. Justice Sunil Hali after hearing Adv LK Moza appearing for the petitioner and Adv PS Chandel appeared for the Union of India and also gone through the observation made by the state high court in a identical case and allowed the appeal and directed respondent
