| HC issues notice to VC over backdoor appointment in SKUAST | | | EARLY TIMES REPORT Jammu, Mar 18: Justice Hakim Imtiyaz Hussain of J&K High Court in a petition filed by Shabnam Sheikh challenging the appointment of Supt legal SKUAST, has issued notice to Sher-e-Kashmir University of Agricultural Sciences Technology through its Registrar, Vice Chancellor, Dr. Nagendra Sharma Ex-VC SKUAST, Principal Secretary to chancellor, Commissioner of Vigilance, Dr. A K Srivastva Ex-Director, Chairman Selection Committee for the post of Legal Supt, Dr. C S Kalha Member Selection Committee, Iqbal Singh Member-Secretary Selection Committee, Wasim Nargal Co-Opted Member of Selection Committee Standing legal Counsel SKUAST, A K Koul Member Secretary Selection committee, Vinayak Vikram Supt Legal SKUAST. After hearing Adv SS Ahmed appearing for the petitioner dictated this order in the open Court today and ordered. Meanwhile appointment of respondent No 11 (Vinayak Vikram) shall remain subject to outcome of the writ petition and further ordered that respondents to keep original record available at the time of consideration of the matter. Petitioner claimed to be law graduate did her LL.B (Professional) from Jammu University in August, 2005 and presently undergoing LL.M Studies challenged the appointment of Vinayak Vikram as Supt Legal and alleged that for the last three to four years in view of several complaints of illegal/backdoor appointment made during the tenure of Dr. Nagendra Sharma as Vice Chancellor, after the demitting of the office by the said respondent took a policy decision to clear the mess created by former VC and in this regard the SKUAST vide his number AUJ/ADM/09-10/5014-36 dated September 17, 2009 terminated the service of 296 contractual and adhoc appointment employees on the plea that said engagements were made illegally and adheres the constitutional scheme of public employment on pick & choose basis beyond the budgetary provisions sanction by the state government, after the submission of the audit report the Chancellor of the University referred the matter for through probe to the State Vigilance Organization and SVO registered FIR 19/2009 against then VC and Ors for making illegal/backdoor appointments. It has been submitted that the role played by respondent No 9 who happens to be standing legal counsel for SKUAST and was a Co-Opted Member of Selection Committee which screened the candidature and backdoor appointment of respondent No 11, alleged that he become a rubber stamp having expertise on constitution and selection matter and prefer to toe the line of other members of the selection committee solely to appease the Vice Chancellor of the University. It was further said that it is quite unfortunate that respondent No 9 who belongs to an institution of law and justice allegedly become hand-in-glove with the other members of the selection committee to pave way for the backdoor appointment of respondent No 11 (Vinayak Vikram) instead of acting as sentinel of role of law. It was prayed by the petitioner for quashing the order dated April 11, 2007 whereby respondent No 11 (Vinayak Vikram) was appointed illegally through backdoor as Supt Legal. JNF
