| Court acquits accused in gang rape case | | | EARLY TIMES REPORT JAMMU, Mar 18: Principal Sessions Judge Jammu BL Bhat acquitted Mohd Yaqoob alias Juba, Rafiq Ahmed and one Showkat Ali who died during the pendency of the case and his name was deleted from the accuser’s list, allegedly involved in gang rape case. According to case accused persons allegedly abducted a married woman from the backyard of her house forcibly and after gagging her mouth committed rape on her in field of wheat crops. Allegedly rape was committed on the intervening night of April 10-11, 2005. On the complaint Police Station Nagrota registered a case u/s 376/366/342 RPC and after completion of the investigation challan was presented in the Court of law. Prosecutrix deposed that she had visited Kapoorgarh to attend a marriage ceremony. Her husband and sister too were with her. Three unidentified persons lifted her at night and taken her to field and raped her by turn. She stated that accused were not known to her. Principal Sessions Judge Jammu after hearing both the sides observed that on careful consideration of the evidence brought on record by the prosecution. Court finds that there is no legal proof linking the accused with the alleged commission of crime. In absence of substantive evidence of complicity, it is futile to seek their explanation and acquitted the accused from the charges leveled against them. JNF |
