| HC restrict official to take any policy decision | | |

Jammu, Mar 19: Justice Hakim Imtiyaz Hussain of J&K High Court in a petition challenging the adjustment of Dr. Dara Singh as Deputy Medical Supt SMGS Hospital Jammu has directed till objections are filed and the matter is considered, the Deputy Supt shall not take any policy decision and also shall not exercise financial powers vested in the post. High Court after hearing Adv SK Shukla for the petitioner Dr. Nirupam Madaan issued notice to State of J&K through Principal Secretary Health & Medical Education Dept, Principal GMC Jammu and Dr. Dara Singh Assistant Surgeon presently Deputy Medical Supt SMGS Hospital Jammu returnable within two weeks. The counsel for the petitioner has referred the eligibility and qualification of Dr. Dara Singh to hold the post of Deputy Medical Supt, he also referred to the Govt order dated February 26, 2010 which is impugned in the present petition and submitted that respondents Commissioner/Secretary and Principal have selected respondent No 3 for the post of Deputy Medical Supt despite the fact that Dr. Dara Singh does not possess the requisite qualification. Court appears prima-facie case in favour of petitioner for grant of interim relief and directed the registry to list after two weeks. ---JNF
