Police await sanction under Sec 6 AFSPA

JAMMU, Mar 22: The police are waiting for New Delhi's nod for producing a charge sheet against BSF commandant RK Bardi accused of ordering killing of a Nishat youth on February 5.

The police told the officiating Chief Judicial Magistrate (CJM) Srinagar that they were waiting for two forensic reports and Union Home Ministry's nod for producing the charge sheet against the accused commandant and Constable Lakhwinder Singh.

The counsel for the slain youth, Zahid Farooq's parents, GN Shaheen sought immediate filing of charge sheet against the accused. However, SDPO, Nehru Park, Muzaffar Shah told the court that the police were awaiting two forensic reports which shall be used as evidence against the accused. "For producing the charge sheet, the police need permission of the Union Home Minister. The ministry ahs been contacted and a decision is expected shortly", he said.

The counsel for the accused, Advocate Moulvi Aijaz sought permission for allowing the accused to have a telephonic conversation with their family members. However, the court denied the permission. Later, both the accused were remanded to judicial custody for 14 days.

Constable Lukhwinder in a confessional statement recorded by a magistrate under Section 164 CrPC has said that Commandant Bardi ordered him to shoot the boy. The commandant, however, has denied the allegation.

The police need sanction from Union Home Ministry for bringing the accused to justice. It is a requirement under Section Armed Forces Special Powers Act (AFSPA). Although the Chief Minister has assured the relatives of the slain youth that AFSPA won't hamper administration of justice but senior lawyers hold a contrary view. Advocate Parvez Imroz, who is an expert on human rights cases said the challan cannot be produced without sanction of the Home Minister.
