| Bill aimed at checking overloading in vehicles introduced in LA | | | EARLY TIMES REPORT JAMMU, Mar 23: Minister of State for Finance and Cooperative, Dr Manohar Lal Sharma today introduced "a Bill to amend the Jammu and Kashmir Excise Act, Samvat, 1958 and the Jammu and Kashmir Levy of Toll Act, Samvat 1958 (LA Bill No 10 of 2010)" in the Legislative Assembly today. Explaining the objectives of the Bill, the Minister said that the amendment is aimed at checking overloading in vehicles and to enhance amount of penalty on the violators. He said that the penalty prescribed under Section 48 and Section 60 of the Jammu and Kashmir Excise Act, Samvat 1958 has not been changed for the last many years. In order to ensure that there is strict compliance of the provisions of the Act, it has become necessary to enhance the quantum of penalty under the said sections. Accordingly, necessary amendments have been proposed in Section 48 and Section 60. Manohar said that there are instances where vehicles are carrying load and passengers beyond the prescribed limit, as per the registration certificates. However, there is no specific provision for levy of any penalty or for levy of double the amount of toll on such vehicles. He said the proposed amendment has been brought in order to check such instances of overloading. Minister said that the fine amount under the J&K Levy of Tolls Act, Samvat 1995 has not been enhanced in the recent past. In order to curb evasion of Toll, it has become necessary to enhance the fine amount suitably. Accordingly necessary amendment has been proposed in Section 8 of the said Act.
