| HC directs promotion of petitioner in SRTC | | | Early Times Report
Jammu, Mar 23: Petition seeking promotion as Junior Assistant with effect from October 23, 1975 and Senior Assistant with effect from September 23, 1985 as petitioner's his junior came to be promoted. Justice Mansoor Ahmed Mir of J&K High Court directed J&K State Road Transport Corporation to consider the case of petitioner and grant him promotion from the date similarly as his juniors have been promoted. This significant direction has been passed in a petition filed by one Tarsem Kumar through Adv Abhinav Sharma in which it has been submitted that petitioner was appointed as conductor in the year 1969 and came to be promoted as Junior Assistant on January 21, 1986 and in the said order he was figuring at serial No 1, he was allotted registration No 1118 but thereafter he was not assigned any job and the said registration number came to be allotted to Uttam Raj. The petitioner approached the respondents for allowing him to discharge the duties of junior assistant and made so many representations but the respondents failed to redress his grievances. The petitioner feeling aggrieved has filed this petition seeking direction to the respondents to promote him as Junior Assistant with effect from October 23, 1975 and senior assistant with effect from September 23, 1985. It is also mentioned in the petition that his juniors came to be promoted, but he has been ignored. The respondents filed their objections. As per documents placed on file, petitioner is matriculate and was figuring higher in the seniority list as compare to the private respondents.
After hearing both the sides, Court observed that the counsel for the petitioner stated that three conductors had filed petitions which came to be allowed by this High Court vide different orders in the year 2000 and further submitted that respondents without any justification has denied the right of promotion to the petitioner. Court further observed that deem it proper to dispose of this petition with the direction to the SRTC to consider the case of the petitioner and grant him promotion from the date similarly situated persons and his juniors have been promoted and appropriate order be passed within a period of three months from the date. A copy of this order is served upon them by the petitioner and disposed of petition along with CMPs. -----JNF |
