| Alleged murder of NC Leader, FC Home files affidavit in contempt | | | Early Times Report Jammu, Mar 24: Alleged murder of NC Leader Ghulam Mohd Rather childhood friend of Ghulam Nabi Azad presently Union Health Minister, as per the direction of the High Court, Financial Commissioner Verghese Samuel filed his affidavit through Additional Advocate General Jagdish Parihar in which it has been submitted that SRO 92 of March 2, 2010 was issued that the case may be transferred to CBI for through investigation, in compliance to the direction of the Chief Minister. " It is further submitted in the affidavit filed by Financial Commissioner Home that in compliance to the directions of the Chief Minister, the Home Dept issued SRO 92 of March 2, 2010 by which consent was accorded to the extension of powers and jurisdictions of the members of the Delhi Special Police Establishm-ent to the state of J&K for investigation of offences u/s 302/341/34 RPC arising out of FIR No 22/2007 of P/S Gandoh.
This affidavit was filed on the direction of the State High Court in which the petitioner Ghulam Rasool Rather a close relative of the deceased Ghulam Mohd Rather has filed supplementary affidavit in terms of order dated March 11, 2010 passed by the High Court in a contempt petition. The affidavit filed by the petitioner through Adv Sheikh Shakeel Ahmed in which a detailed matter of the case was submitted in which the LPA filed by the Natha Singh & Sher Alim, Division Bench on February 18, 2010 declined to show indulgence and passed a speaking order thereby upholding the order of July 10, 2009 passed by the Writ Court. It is further submitted that the aforesaid facts and circumstances clearly established that whatever progress was achieved during investigation, the same was due to the continuous monitoring of the High Court and on culmination of the investigation the accused in order to escape from the prosecution adopted a noble method by approaching the chief minister so that the matter gets scuttled and they were benefited. The ends of the justice warrant that the law must take its own course and the accused must be brought to book in accordance with law. Detailed 17 pages affidavit filed by the relative of the deceased who is a petitioner further submitted that in a democratic country where there is a rule of law, no one can claim to be above law and the way the office of Chief Minister, his Principal Secretary and Financial Commissioner Home dealt with the matter by entertaining the representation of the accused is ex-facie contemptuous and appropriate action is warranted against them for upholding rule of law.
The petitioner prayed before the Court that keeping in view submissions made, Court may very kindly be pleased to initiate appropriate action against the senior functionaries of the State of J&K who were instrumental in the issuance of SRO 92 dated March 2, 2010 despite the pendency of the petition.
