Man gets life for killing wife

JAMMU, Mar 30: A man, who killed his wife with a rolling-pin for her issueless status in 2003, was Monday sentenced to life imprisonment by principal sessions judge, Jammu. Ganesh Dass had picked up the rolling-pin from kitchen and hit it on his wife Vimla Devi's head at their residence at Samral near Jhajjar Kotli tourist resort on May 25, 2003, resulting in her instant death. The matter was brought to the notice of the Samral numberdar Madan Lal by Ganesh's neighbours -- Madan Lal, Kewal Krishan and Krishan Lal. The numberdar had then reported the matter to the Jhajjar Kotli police station.
Acting on the complaint, police had arrested Ganesh and booked him in a murder case. According to the prosecution case, the couple was childless even after 13 years of their marriage. This troubled Ganesh, who often picked up a quarrel with her over this issue. He got further irritated when Vimla adopted her six-year-old nephew Rahul and started bringing her up. On the day of the incident, there was a quarrel between them after which Ganesh hit a rolling-pin on Vimla's head as a result of which she was killed on the spot. After completion of investigation into the case, police presented challan in the court of law. After hearing lawyers of both sides, principal sessions judge, Jammu, B L Bhat awarded life imprisonment to Ganesh along with a fine of Rs 1,000. Pronouncing his judgement, the judge observed that the convict was proved to have committed murder of his wife using a rolling-pin as weapon of offence late at night. It had been established that the accused used to quarrel with the deceased and an incident of quarrel had also preceded the murder of Vimla, attracting neighbours, who had heard cries emanating from the house of the accused. All the eyewitnesses turned hostile during the trial and the proof of guilt of the accused rested on the circumstantial evidence and the recovery of weapon of offence pursuant to his disclosure statement. Admittedly the instant case was not one of the rarest of rare cases. Court was of the considered opinion that life term would be commensurate with the level of guilt proved against the accused.
With these observations, the judge awarded life imprisonment to the accused along with a fine of Rs 1,000.
