| Justice AH Saikia to be new Chief Justice of J&K High Court | | | EARLY TIMES REPORT
NEW DELHI, APRIL 1: President Pratibha Patil has transferred the Chief Justice of Sikkim High Court Aftab Hussain Saikia as Chief Justice of Jammu and Kashmir High Court through an order passed here today. Earlier, Chief Justice Barin Ghosh of J&K High Court was transferred to Sikkim High Court as Chief Justice through a Presidential order. Thus, the two Chief Justices have virtually been interchanged between the two High Courts. Ever since the transfer of Justice Ghosh the appointment of his successor was awaited. This had also given indication about the possible swapping of the post by the two Chief Justices, or Justice Ghosh and Justice Saikia. Ending all speculations in this regard, Ministry of Law and Justice issued a Press note here today to announce the transfer of 61-year-old Justice Saikia from Sikkim to J&K High Court. Justice Saikia has earlier practised in Guwahati High Court as a senior advocate. Later he became a judge of Guwahati High Court. The Law Ministry Press note said, "In exercise of the powers conferred by clause (1) of article 222, of the Constitution of India read with article 222 (1A) of the Constitution (Application to Jammu and Kashmir) Order, 1954, the President, after consultation with the Governor of Jammu and Kashmir and the Chief Justice of India, is pleased to transfer Dr. Justice Aftab Hussain Saikia, Chief Justice of the Sikkim High Court, as Chief Justice of the Jammu & Kashmir High Court and to direct him to assume charge of his office in the Jammu & Kashmir High Court on or before 13th April, 2010." Yet the time gap of nearly three weeks between the announcements of two transfers gave rise to a little row between bar associations of J&K High Court and Sikkim High Court. Members of the later took exception to a claim by the former that Justice Barin Ghosh's transfer to Sikkim was a virtual punishment. The Sikkim Bar Association passed a resolution saying that such an assertion by their J&K counterparts was detrimental to the majesty and dignity of the high office of the Chief Justice of Sikkim High Court.
