| Infamous land scam, HC issued contempt notice to IG, SSP Crime | | |

Jammu, Apr 2: New Jammu Township Project Scam, in which Crime Branch presented challan against Moulvi Iftikar Hussain Ansari then Minister Housing & Urban Development presently MLA PDP, Jayant Bhuta, Madan Lal Kalra, Dr. Amjab Abas Ansari and B Murlidar, a contempt petition was filed by one B Murlidar one of alleged accused in the scam seeking initiating contempt proceedings against IGP Crime Branch and SSP Crime Branch Jammu for having willfully and knowingly violated the interim arrangement of December 30, 2009 made by the High Court on concession of respondents, Justice Mansoor Ahmed Mir of J&K High Court after hearing Adv Anil Sethi appearing for the petitioner, issued notice to IGP and SSP of Crime Branch Jammu returnable with in two weeks.
Petition seeking quashment of FIR NO 175/1998 of P/S Bahu Fort was filed in the High Court in which on July 16, 2009 notices were issued. At the same time it was informed the Court that respondents are taking steps to serve same. Hukamnama upon the petitioner. That again when the matter was listed after months, respondents were not in a position to file objections and counsel for the respondents made a statement at Bar that formal charge-sheet is not intended to be submitted and that the matter be taken up for final hearing. According to the counsel for the petitioner in other words it was agreed by both the sides till that matter is finally heard by the Court, formal report u/s 173 CrPC (Challan) shall not be filed and that respondents shall not cause any prejudice to the petitioner. In the petition it was further submitted that in sheer disregards to the Court's orders and to show disrespect to the authority of the court, Crime Branch went ahead with process of presenting the final report. They did so within a week of receipt of the interim orders. Whereas the Crime Branch had taken almost 12 years to complete investigation and was still dragging their feet, the service of the interim order upon them appears to have ignited the process of reckless investigation. Formal charge sheet was filed before the Special Judge Anticorruption Jammu on January 6, 2010 and prayed for initiating contempt proceedings against respondents. ---JNF
