| HC stays impugned order, issues notice to Taj for making forcible retirements | | | Early Times Report Jammu, Apr 6: Justice Mansoor Ahmed Mir of J&K High Court in a petition filed by 17 employees of Public Health Engineering (PHE) District Poonch challenging their forcibly pre-mature retirement, stayed the operation of impugned order and issued notice to Taj Mohi-ud-Din Minister for PHE & Ors. Petition filed by Abdul Aziz and 16 others of PHE Division Poonch had been pre-maturely retired from the service with effect from March 31, 2010. Advocate Shahzad Azeem appearing for the petitioner submitted that the petitioners have long service at their back and have yet to attain age of superannuation. Petitioners have not forwarded any application for premature retirement but executive engineer PHE Division has issued order dated March 9, 2010 whereby the petitioners are treated to have been prematurely retired with effect from March 31, 2010. It was further submitted that petitioners have made representation to the respondents in which they have pleaded that they being petty class IV employees are leaving from hand to mouth and prayed that they may be allowed to continue till they reach the age of retirement. Counsel for the petitioner further submitted that news item published in the newspapers wherein it was reported that Govt has to retire 3500 PHE employees forcibly, impugned order is the outcome of the same. Justice Mansoor Ahmed Mir after hearing the counsel for the petitioners issued notice to the Minister for PHE, Taj Mohi-ud-Din and Others returnable within four weeks. In the meantime subject to objections from other side and till next date of hearing the operation of impugned order is stayed. ---JNF |
