| Sampat condemn imposing of ESMA | | | Early Times Report Jammu, Apr 6: By imposition of Essential Services Maintenance Act (ESMA) to suppress the on going struggle of employees and pensioners for release of arrears of 6th pay commissions, reflects the lackadaisical approach of the state government in providing relief to the employees, said well- known trade union leader, Sampat Parkash in a statement issued to the press here today. He said the basic rights of the employees to the benefits, which the 6th pay commission has recognized and recommended and their right to resort to strike, a legitimate and legally institutionalized method to seek the redressal against denial of their rights, are unassailable and unquestionable. He said for the last five decades, even during the most turbulent times, the state passed through, the state governments, respected the rights of its employees to seek redress and lawful trade union activity including strikes. The sudden and irresponsible action of the state government to enforce such draconian laws as the Essential Services Maintenance Act, to scuttle the growth of powerful strike is condemnable. Equally condemnable is the action of the government to the imposition of "no work no wage", which along ESMA is only aimed to scuttle the struggle of employees for their rights. He further said the state government opened negotiations with its employees assuring them due consideration of their demands for the release of the arrears of the 6th Pay commission and the negotiations have continued for over a year, during which time, the employees have resorted to legitimate and legally rightful trade union activity, including strikes to persuade the state government to redress their grievances. To bring the process of negotiations with its employes, abruptly to an end, with the imposition of the Essential Services Maintenance Act to suppress their voice cannot be justified by any standards and exposes the insensitivity of the State Government to the suffering of its people and its incapability to follow any progressive policy in regard to the welfare of its employees. He said had the employees dealt with the government in a coordinated manner under one platform and join leadership and involved the unions of gazette employees and the pensioners in their struggle, the state government would not have dared to impose the draconian orders, it has done. He appealed to all the factions to coordinate their movement under one platforms and evolve high power apex body in their struggle, the unions of the gazette employees and the state pensioners. |
