| Police file challan against BSF CO | | | Early Times Report JAMMU, April 6: The police today filed a challan in the court of Chief Judicial Magistrate (CJM) at Srinagar against BSF commandant RK Birdi and Constable Lukhwinder Singh in Zahid Farooq case. The police produced the challan today in absence of the accused under sections 302, 120B, 307 of Ranbir Penal Code (RPC). The accused have also been charged under section 210 RPC for destroying evidence. The CJM after receiving the challan and fixed the next date of hearing on April 8. Owing to employee's strike no orders could be issued today. No clerk was present to check the documents presented by the police. The special team constituted by the government is believed to have consulted senior legal experts of the state while framing the charge sheet. The police are heavily relying on the confession of Constable Lakhwinder who was stated that his commandant ordered him to shoot Zahid Farooq on February 5 near Brian Nishat. The commandant has denied the allegations. Both are in Central Jail on judicial remand. The police have won acclaim for producing the challan. However, on April 8, the court will seek sanction to prosecution under section 6 Armed Forces Special Powers Act (AFSPA). The trial shall start only when the state produces the required sanction. Zahid Farooq a 11th standard student was allegedly shot dead by BSF men on February 5 near brain Nishat. The killing evoked massive demonstrations across Kashmir. The clashes left around 150 persons including fifty police and CRPF men wounded.
