Police refuses despite compromise, HC finally quashes FIR against husband by wife

Jammu, Apr 7: Wife lodged a complaint against husband u/s 498-A (demand of dowry) and 323 RPC and after some time when she realized that she been made part of plot to break matrimonial wed-lock, she made a statement before the Court of Sub-Registrar Jammu by way of duly sown affidavit deposing all the true facts and as such while making the statement against the husband, said that cordial matrimonial relation between both produce the document of Sub-Registrar Court before SHO Poonch by way of formal representation by Pratima Chadha wife of Sanjeev Chadha requesting the authority to close the investigation but the SHO and the Investigating Officer are harassing the petitioners by not brining the investigation to its logical conclusion by taking on record the categorical statement of the wife duly sworn before the Sub-Registrar Court Jammu, upon the attitude of concerned police, the petitioners filed a petition before the High Court seeking quashment of the FIR.
Justice Sunil Hali after hearing Advocate Govind Raina appearing for the petitioner and AAG Jagdish Parihar for the state, observed that it is contended that matrimonial discord as led to filling FIR NO 113/2009 against Sanjeev Chadha husband of the petitioner Pratima Chadha u/s 498-A r/w section 323 RPC registered in P/S Poonch.
The parties have resolved their dispute and agreed to live as husband and wife. Petitioner have filed a compromised deed in this Court seeking quashment of the FIR, Court after perusing the compromised deed and contents of the application further observed that in view of the fact that the parties have resolved their disputes by entering into a compromise, Court allowed this petition and FIR NO 113/2009 registered against Sanjeev Chadha in P/S Poonch u/s s 498-A r/w section 323 RPC shall stand quashed. ---JNF
