Contempt Petition filed by Computer Operators of High Court
HC directed Com/Secy Law to appear in person

Jammu, October, 14:- In contempt petition filed by Nisha Saraf and Others Computer Operators and Data Entry Operators of State High Court, Justice Nirmal Singh of J&K High Court Jammu Wing directed Commissioner/Secretary to Law Department to appear in person on the next date of hearing.



Court took this serious step against the law Secretary that statement of facts has not been filed; Additional Advocate General Mr. SC Gupta seeks and is allowed four weeks time as last opportunity for filling the statement of facts.



The petitioners who are working in the state High Court has filed contempt petition seeking contempt proceedings against the erring respondent for willfully disobedience and non implementation of the order passed by Single Bench of the High Court dated January 27, 2000 and upheld by the Division Bench on June 11, 2002. The state Govt filed SLP before the Supreme Court of India; Supreme Court passed order and modified the order of the High Court to the extent that the revision of pay-scale was to be granted from the date of pre-announcement. The partial compliance to the order passed by the court vide Govt order dated February 14, 2003 sanction was accorded to up gradation of 14 posts of Data Entry Operators working in the J&K High Court. It is further submitted that second part of the judgment is still unimplemented whereby the 25 % posts of available 14 posts were required to be upgraded on selection from am amongst the employees who have put in five years services.



The petitioners made representation to the Govt more over a legal notice was also served upon the Commissioner/Secretary to Govt Law Dept seeking implementation of the judgment but no action has been taken till date and filed this contempt petition in which the petitioners prayed through Advocate Anil Khajuria for initiating contempt proceedings against the respondents for disobeying the order of the High Court.
