| Court granted bail to RR Jawan, who was caught with alive Grenade | | | Jammu, October, 14:- Chief Judicial Magistrate Jammu Mr. Sanjay Dhar granted bail to Kale Manoj serving in Rashtriya Rifles, who was caught by the Railway police on Railway Station Jammu along with a live grenade.
According to the police story that on October 3, 2006 at about 8:00 PM, police officials on duty subjecting the luggage of the passengers to ex-ray check, the found the image of grenade. The bag of the passenger was searched and a live grenade was recovered, the passenger was identified as Kale Manoj Sepoy of Rashtriya Rifle and was arrested u/s 4/5 Explosive Substances. The accused was also interrogated.
CJM Jammu Mr. Sanjay Dhar after hearing Chief Prosecuting officer appearing for the state and Advocates Ashwani Sethi and Sanjay Sharma appearing for the accused persuade the report filed by the police held that the counsel appearing for the accused submitted that accused is member of para-military force, was issued the grenades by his unit at the time of operation, however, at the time of packing his luggage, he inadvertently, left the grenade inside his luggage, it is contended that a certificate in this regard has been issued by the Commanding Officer, which has been forwarded to the SHO P/S Railway Jammu. The certificate in question is also on record of the case dairy. The accused has been in custody of the police and has been subjected to sustained interrogation, even the investigating agency as not been able to find any other angel till date with regard to the alleged occurrence excepting the one put-forth by the counsel for the accused.
CJM further observed that the investigation of the case is almost complete and no further recovery is to be effected from the accused. The offence alleged to have been committed by the accused is neither punishable with death sentence nor imprisonment for life. The accused is a member of para-military force and there is no criminal antecedents of the accused nor there is any chance of the accused fleeing from the process of law, as such he is admitted to bail subject to furnishing of bail bond and surety bond to the tune of Rs 20,000/- each with the direction that accused co-operate with the Investigating Agency and shall not temper with the prosecution evidence. |
