| ‘Torture of maid in Girls Hostel’ | | JU panel report 'tailored' to save warden, scrap it, SHRC tells VC | | EARLY TIMES REPORT JAMMU, Apr 8: Over an year after the occurrence of the incident of alleged torture of a minor maid by the then Warden of Girls Hostel Jammu University, the State Human Rights Commission has asked the Vice Chancellor the scrap the report given by the Committee of four Professors and take fresh view of the developments in the incident followed by an action mandated by the law which is necessary for health and dignity of the institution. While disposing of the case after considering the details of the complaint registered in this regard by Balraj Puri, Convenor of PUCL(People's Union for Civil Liberties), the Human Rights Commission has observed that University of Jammu has not dealt with the case with all the seriousness it deserved. The Commission has also noted that copies made available of the report of the Provost, complaint of the boarders signed by all the boarders of the hostel and their meetings with students as well as the then Vice Chancellor and also the presentation of Registrar before the Commission go all to show that the matter is and has been quite serious to invite disciplinary action(s) as per law, rules and regulations of Jammu University in the case of an erring staffer, Misha Gupta, Incharge Warden of Girls Hostel. The Commission, which heard and concluded the case in March this year has also said that in the judgment that observations of the Provost of the hostels on written complaint of the boarders of the Girls Hostel and reporting of the matter to Police by the Registrar of University is quite serious to call for action on part of the University authorities. The judgment says that the constitution of the Committee by the Vice Chancellor comprising Prof Neelam Saraf, Prof VP Magotra, Prof NK Tripathi and Suman Jamwal to look into the allegations made by the boarders of Hostel against warden has simply lead to wastage of time and bypassing the real issue and the misconduct. "In the light of and on terms of report of this committee made available to the Commission, ex facie an attempt is made to save the warden and give her an escape route and to cool down the situation of her own creation to her advantage…………on going through the copy of the report of the Committee of four Professors, a fair and substantial impression and inference is drawn that what this committee reports is wholly untru and palpably and prima facie wrong in the face of what is stated by Provost in the show cause notice served on the Warden besides what is stated in blue and white in the write ups signed by all the boarders as given to the authorities……", Justice Syed Bashir-u-Din, Chairperson of the State Human Rights Commission said in the judgment remarks. The medical report is also wrongly and out of context referred in its report by the Commission, the SHRC felt adding that instead of looking into allegations of misconduct of the Warden vis-à-vis the boarders, the Committee has tried to draw a report concetric to the 16 years old maid Meera and that too while ignoring the statements of Meera and other eye witnesses to the occurrence. "The whole exercise appears to be tailored……", the Commission has observed. The HRC has said that apart from action taken on the criminal side, the disciplinary action needs to be taken to uphold the dignity of life and equality and ensure equal protection ,equality before law, as mandated by the constitution.The HRC has asked the University to send Action Taken Report or Proposed Action Taken Report within one month to it unless extended in terms of section 19 of the Protection of Human Rights Act of J&K.
