Central Govt Employees services matters not jurisdiction of HC

Jammu, Apr 10: Justice Hakim Imtiyaz Hussain in a petition filed by an IFS officer seeking quashment of his transfer on non-cadre post, has said that in view of the section 14 of the Central Administrative Tribunal Act 1985 jurisdictions to entertain service matter in respect of members of All India Service vests in the Central Administrative Tribunal and High Court does not have the jurisdiction to entertain the service matter of members of All India Service.
The jurisdiction vests in the Tribunal not only in respect of a member borne on the cadre of service but also regarding appointment to an all India Service or post borne on the cadre of the service. With these observations Court dismissed the petition not maintainable under Article 226 of the constitution before this Court. Sr. Adv Sunil Sethi with Adv Ravi Abrol appeared for petitioner whereas Advocates R Koul, Vipin Gandotra and Nitin Bhasin appears for the respondents. --JNF
