| Court grants pre-arrest interim bail in CBI case | | | EARLY TIMES REPORT JAMMU, Apr 14: Special Judge Anticorruption J R Kotwal granted interim anticipatory bail to Pritam Singh and Jasvinder Singh partners of a rice sheller Dablahar RS Pura against whom CBI registered a case along with others for obtaining loan from SBI Branch Kacchi Chowni to the tune of Rs 1, 13, 50, 000/- on allegedly fraudulently documents. According to FIR registered on March 31, 2010 u/s 120-B r/w 420, 468 and 471 RPC and 5(2) r/w 5(1)(d) of J&K PC Act against petitioners and two others of which investigation is at initial stage and accused are required for sustained interrogation. It is further contended if anticipatory bail is granted to the petitioner at this juncture, there is likelihood that they will not cooperate with the CBI and would hamper the investigation and may temper with the prosecution evidence.
Special Judge Anticorruption JR Kotwal after hearing Adv Abhinav Sharma for the petitioners and Sr. P P for the CBI and after going through the bail applications and objections filed by the CBI, observed that accusations leading to the FIR is that the petitioners who are partners of a firm are not the owners of the land and the house mortgaged by them as collateral security with SBI Branch Kacchi Chowni Jammu for securing loan facility to the tune of Rs 1, 13, 50, 000 for establishment of their business unit and copies of Khasra, Girdawri and Intkhab Jamabandi used for the purpose of the said collateral security have been falsely prepared . Investigation of the case, thus involves two important aspects firstly whether the petitioners are not the owners of the property and secondly whether the copies of Khasra, Girdawri and Intkhab Jamabandi are forged documents. The IO has not collected any material as regards the first allegation that petitioners are not the owners of property, the IO in the course of arguments submitted that he has verified the position in the revenue record and is in the process of collecting the record for the purpose of evidence. Court after hearing both the sides adjourn matter and granted interim anticipatory bail to petitioners with the direction that in the event of petitioner’s arrest during pendency of this application shall be released on furnishing personal bond along with surety in the amount of Rs 20,000 each with certain directions.
