| Court dismisses bail of police cop involved in alleged rape | | | EARLY TIMES REPORT JAMMU, Apr 15: Chief Judicial Magistrate (CJM) Jammu YP Bourney dismissed the bail application filed by police cop Shakeel Ahmed who was involved in alleged rape at Railway station on the intervening night of March 9 and 10, 2010. According to the report filed by Chief Prosecuting officer Pawan Khajuria along with his objections that accusations against the applicant is that on the intervening night of March 9 and10, the applicant posted as constable spotted the posecutrix taking dinner at Rehri. The applicant ordained the prosecutrix to take her meals to the train halted at the platform. The applicant barged into the train and took the prosecutrix to a dark place and committed rape. The police was informed on the morning of March 10 and a FIR was registered. In a swift action, Investigating Officer arrested the accused constable and also got victim medically examined. The statement of the complainant has also been recorded under section 164-A Cr PC and the medical report has also been obtained which has also confirmed the recent intercourse. CJM Jammu after hearing both the sides and gone through the police report and CD filed, held that prosecutrix had made statement on oath before Judicial Magistrate where she has narrated all the detail of the facts and circumstances in which she was abused sexually by the applicant. Her version had been further confirmed by the medical report. There is nothing unnatural in the statement of the prosecutrix. The offence allegedly committed is heinous and carries imprisonment up to life. The offence becomes more heinous when it is committed by none else then a constable on duty who is required to guard the society more particularly weaker sections from being victimized. The petitioner does not deserve any leniency, hence the application is dismissed. ---(JNF)
