Court framed charges against father, son in cheating case

Jammu, Apr 16: Case against Ghulam Rasool Vakil alias Lassa Vakil and his son Omar Vakil in a cheating case, 2nd Additional Sessions Judge Vinod Chatterji Koul framed charges u/s 419/420/467/468/471 r/w section 120-B RPC.

According to the CPO VOJ Purshtom Sharma that on October 1, 2004 Mustaq Ahmed Ganai alias Mustaq Chaya approached vigilance organization stated that Ajit Kumar IAS then Principal Secretary (retd) Govt Forest Dept called him and asked him to help his friend Ghulam Rasool Vakil alias Lassa Vakil by making him business partner in supply of timber to the forest dept J&K Govt when complainant refused to take Lassa Vakil as his partner, Ajit Kumar IAS threatened and also compelled him by saying that he will not allow any one to do business with forest dept if Lassa Vakil is not helped. Ajit Kumar asked Principal Chief Conservator of Forests to help Lassa Vakil for doing business with forest dept who referred him to conservator of forests under undue and illegal influence exerted by Ajit Kumar IAS, Mustaq Chaya was forced to allow the name of one of his companies M/S ALPs Forest Company to be used by Lassa Vakil for supply of timber through forest dept. it was further alleged by Mustaq Chaya that Lassa Vakil had collected cheques issued in the name of ALPs Forest Company and deposited the same in air-cargo branch of J&K Bank Srinagar in the name of M/S ALPs Forest Company and had defrauded complainant worth of more than Rs 64 lacs.

During the investigation conducted by Vigilance organization, allegations to the offence u/s prevention of corruption act was not made against Ajit Kumar IAS but other offences mentioned in the said FIR are found to have been committed alleged accused namely Ghulam Rasool Vakil alias Lassa Vakil and his son Omar Vakil. 2nd Additional Sessions Judge Vinod Chatterji Koul after hearing both the sides, rejected the plea of defence counsel that Vigilance organization cannot file the charge sheet when offence other than PC Act are established during the investigation of the case and framed charges against Ghulam Rasool Vakil alias Lassa Vakil and his son Omar Vakil u/s 419/420/467/468/471 r/w section 120-B RPC.
