| Court restrains gen secy, treasure JKCA from conducting activities | | | EARLY TIMES REPORT JAMMU, Apr 22: Jammu and Kashmir Cricket Association (JKCA) today suffered a jolt when a local court "temporarily" restrained its general secretary and treasurer from conducting the activities and affairs of the association, besides restraining from using the funds in violation of the rules and regulations governing the administration and management of the association till April 27. In an application filed by Sandeep Gupta and others Vs J&K State Cricket Association and Others for grant of temporary injunction, Additional District Judge Jammu RS Jain today restrained the general secretary and treasurer of JKCA from conducting activities and affairs of the association. The Court, however, ordered that this order is subject to objection of the defendants and issued notice to the defendants to file objections on next date of hearing. This Suit has been filed by Sandeep Gupta and Ors for issuance of mandatory injunction, directing General Secretary & Treasure of JKCA to administrate J&K Cricket Association on the basis of decision of the working committee of association and also in accordance with rules governing association and also to restrain General Secretary & Treasure from taking unilateral decision and utilizing the funds and assets of the association at their own level. The Plaintiffs had also sought the appointment of receiver to supervise the election of the office bearer of the working committee of the association for terms of 2010-2011. The Plaintiffs had pleaded that the administration and management of the Association was being done in serious and deliberate breach of rule 8 of the Rules 1957 of the association by the total exclusion of the decision making authority and the administration and management had been usurped in the hands of the office bearers of the association in particular general secretary and treasurer leaving the entire working committee as a mute spectator since the election of the office bearers of the working committee on April 13, 2009. They had alleged that general secretary and treasurer assumed unto themselves the extra legal authority to work for the association, affairs and funds as per their self discretion and discretion of vested interests operating in the association to the exclusion of the working committee. "The latest event in the association evidences the unilateral manipulation at the hands of general secretary and treasurer and that event is the alleged announcement of holding of T-20 cricket tournament by Mohammad Aslam Goni purportedly acting as alleged chairman of JKCA after his recall on account of his anti-working committee posturing and pampering from the membership of the working committee by the Modern Cricket Club Jammu which had sent his nomination to the working committee," they had pleaded. They had also sought an direction for appointment of the Receiver/Commissioner for supervising/conducting the election of the office bearers of the working committee of the association for the term 2010-2011 on account of the expiry of the term of the office bearers of the working committee in the last election held on April 13, 2009.
