| HC rejects job but entitles compensation to petitioners | | |
Early Times Report Jammu, Apr 23: Justice JP Singh decided a very important point of law whether a person claim Govt job in lieu of land acquired by the state, has said that there was no law enforce in the state authorizing grant of employment to one of the member of the family of those whose land had been acquired. This very important law point was decided in a petition filed by Kulwant Singh whose land situated at Village Arnora Tehsil Doda was taken over by the PHE Dept for construction of a reservoir. The petitioner has neither been paid compensation nor any other relief in lieu of his land taken by the dept, he has approached the High Court seeking direction to the respondents to appoint him as class IV employee in the State Govt in lieu of acquisition of his land taking over and deprived him of the only source of irrigation to rest his land which had been rendered un-approached. Justice JP Singh after hearing Advocate Amur Kotwal appearing for the petitioner and Deputy AG Neeru Goswami appearing for the respondents obser-ved that no merit in the petitioner's claim to employment to Govt service for acquisition of his land by the state. The petitioner was entitled to compensation for his land over which the state had constructed the reservoir. However petition held entitled to compensation for his land, the state cannot deprive the petitioner of his property without paying compensation. Court disposed of this petition with a direction to the State to consider the petitioner's case for grant of compensation as permissible under law for acquisition of his land within a period of four months.
