| Court rejects bail to accused in answer sheet scam | | | Early Times Report
Jammu, Apr 27: Chief Judicial Magistrate Y P Bourney rejected bail of Dayal Singh an employee of Board of School Education (BOSE) and Dharam Pal Lab Assistant, Degree College R S Pura on special duty with BOSE involved in answer sheet scam. According police case by Gandhi Nagar Police station, some persons, in connivance with employees of BOSE have been smuggling and supplying answer sheets to students after examination was over and were charging hefty amounts for writing answers for enhancing the merits. On receiving information police raided the premises of Dharam Paul on specific tip of and recovered the answer sheet of Ujjwal Manhas and recovered answer sheet bearing No. 753024 and Roll No. 102928 who had appeared in the paper-A of Physics of Higher secondary Part-II examination. It has come in the investigation that father of Ujjwal Manhas approached Dharam pal and later introduced him with the other accused. Consequently a deal was struck and Rs. 13,000/- was charged which was shared by both the applicants as Rs. 5000/- and Rs. 8000/- respectively. Police registered FIR U/Ss 420, 161, 165A, 120B RPC r/w section 5 Prevention of Unfair Means Act. CJM Y P Bourney perusal of CD file reveals that accused had called namely Ruchi another girl to write the answer in place of Ujjwal Manhas who is yet to be located whereas CPO Pawan Khajuria with PO Pankaj Sethi submitted that accused are involved in the commission of heinous offences and offence under section 409 RPCA has been added during the investigation. The manner in which offence has been committed and the modus adopted has left the public at large particularly the parents of the students appearing in the examination in a state of shock and in the given circumstances, applicants don’t deserve to be given the liberty of bail. As investigation is at initial stage and accused are yet to be interrogated to identify the other persons who are hand in globe with them. CJM Y P Bourney after analyzing allegations and supporting evidence available against accused, observed that there is no doubt that accusations against the accused are well founded and the offences alleged to be committed by them are heinous which have the tendency of destroying the faith of the society at large in the fairness of the examination system. The investigation is in progress and the investigating agency is still in the process of identification of other persons who are either accomplices of applicants or their victims. The release of the applicants at this would seriously prejudice the fair investigation. Moreover, the enormity of the ramification of the conduct of the accused and also the interest of the society at large demands that applicants be not released on bail at this stage as it would not only deprive the investigating agency from opportunity of their sustained custodial interrogation but also would leave them free to tamper with the evidence against them. Applicants therefore, don’t deserve to be enlarged on bail at this stage. With these observations Court rejected the bail application of the both the accused. JNF
