Court acquits heroine smuggler due to miserable police failure

Jammu, Apr 27: 2nd Additional Sessions Judge Vinod Chatterji Koul acquitted one Sham Lal alias Shama of Dangrian Tehsil RS Pura who was facing trial for last nine years in a case of smuggling of heroine, as police miserably failed to prove charge against accused.
According to prosecution case, on July 1, 2001 then SDPO RS Pura, SP Border Jammu while investigating FIR NO 20/2001 were on their way to village of RS Pura arrested accused Yousuf Massi who in custody disclosed that he has concealed one 3.15 Pistols, six Live Cartridges in his house in a box and he had also concealed nine packets heroine in land of accused Sham Lal which they brought from Pakistan. He further disclosed that other nine packets of heroine are lying with accused Sham Lal. The disclosure of accused Yousuf Massi was recorded and on the basis of said disclosure pistol as well as nine packets of heroine were recovered and FIR NO 114/2001 for offence u/s 20/29 NDPS and 3/25 Arms Act was registered and investigation started. Heroine which was seized on the disclosure of Yousuf Massi was found to be carrying the mark Samunder 8888/96 Shah Azam Factory and out the said packets sample was taken and sent to the FSL. On the same the day Sham Lal was also arrested and taken into custody who also disclosed that he had kept nine packets of the heroine in his house which was recovered and mark of the same factory. After completion of the investigation, challan was presented in the Court of law and charge framed on January 10, 2002 against both the accused. During the trial accused Yusuf Massi absconded and proceeding u/s 512 CrPC were initiated against him and today after nine years Court acquitted Sham Lal as the police has miserably failed to prove the charge against alleged accused and so far accused Yousuf Massi who had absconded during the trial Court, challan so far against Yousuf Massi Shall remain alive and order that the arrest of the accused produced before the Court for trial. ----JNF
