5 convicted, sentenced to 5 yrs imprisonment

Kathua, October 15: Chief Judicial Magistrate Kathua Varinder Singh Bhau has convicted and sentenced five persons to undergo imprisonment of two years for commission of offences under various provisions of Arms Act and Ranbhir Panel Code.
The accused convicted by the court include Nek Muhammad s/o Sabar Din, Ramzan Ali s/o Sabar Din, Muhammad Hussain alias Choru s/o Sabar Din r/o Kathua who were facing trial vide FIR No. 476/97 offence u/s 336, 452, 147, 325 RPC, 4/25 Arms Act. The case was registered in the year 1997.
In the Judgement Varinder Singh Bhau Chief Judicial Magistrate Kathua, after hearing Chief Prosecuting officer Ravinder Rao and Prosecuting Officer Ajay Sharma appearing for the state and Advocate for the accused persons, observed that accused have committed offence u/s 336, 452, 147, 148, 325 RPC 4/25 Arms act, which was proved against them during the course of trial. They were accordingly convicted for two years.
Brief facts of the case are that on December 22, 1997 statement of injured Parvez Ahmad s/o Nazir Ahmad was recorded in a hospital where in he deposed that he is 25 years of age and is driver by profession.
He told police that while he was taking his meals in house he heard two/three shots of gunfire outside the premises. He further claimed that as he did not went out of the house, the accused barged inside the house and pelted stones. Accused Nek Muhammad allegedly inflicted blows on his left side of the head and other accused persons attacked the complainant. On his statement an FIR was registered and case was challenged in the court of law.
