Jammu, Apr 30: Special Judge Anticorruption J R Kotwal today awarded 12 years rigorous imprisonment to Bashir Ahmed Bhat then Postal Assistant Gandhi Nagar, Post Office. According CBI, Bashir Ahmed Bhat while posting as postal assistant Gandhi Nagar post office during 1997-1998 by abusing his official position got issued cheque book in the name of account holder one Neelam by forging her signatures on the application made for release of cheque book.
Thereafter used this cheque book and withdraw an amount of Rs 1.50 lacs by forging the signature three accounts holders namely Neelam, R N Sharma and Isher Singh.
Bashir Ahmed made cutting in the official record with a fraudulent intention to facilitate the withdrawal from the said accounts. A regular case was registered on August 13, 1998 and investigation started. In the investigation it has been revealed that Bashir is handicapped, Ujjagar Singh Talwar was posted as Assistant Post Master Saving Bank Gandhi Nagar Post Office.
Investigation has further disclosed that Bashir entered into criminal conspiracy with Ujagar Singh Talwar and Ravinder Kumar auto-rickshaw driver and by abusing his official position committed a fraud of Rs 1, 73, 000 during the February 8, 1997 to March 27, 1998 by making fraudulent withdrawal from three accounts.
In the judgment Special Judge Anticorruption J R Kotwal after hearing Senior Public Prosecutor SK Bhat appearing for the CBI, Advocates Rajesh Kohli, Haq Nawaz Shamas Zargar for accused Bashir Ahmed Bhat whereas for accused Ujagar Singh Talwar and Ravinder Kumar Advocate RK Modi appeared.
Court after considering the case and the record produced by the CBI/ACB, the offence u/s 120-B RPC involvement of Ujagar Singh Talwar not proved in so far Ravinder Kumar is concerned it is too simple to say that there is no evidence at all against him. Out of the 11 alleged fraudulent withdrawals prosecution could succeed in establishing one only as also involvement of accused Bashir Ahmed Bhat in it.
Accused Bashir is found guilty and convicted for commission offences u/s 420, 467, 468, 471 RPC r/w section 5(2) r/w 5(1) (d) J&K PC Act SVT 2006. On the question of sentence it is important to note that accused is a member of a dept of Central Govt and is guardian financial interests of cross section of society. Post offices function at gross route level and are custodian of hard earned money of poor people deposited with them.
Acts of nature as one found to have been committed by accused Bashir Ahmed Bhat have the tendency of shaking confidence of the public in the institution of post offices and awarded rigorous imprisonment for a period three years and fine Rs 5000 u/s 420, 468 RPC, rigorous imprisonment for a period five years and fine Rs 10000 u/s 467 RPC and rigorous imprisonment for a period three years and fine Rs 15000 u/s 5(2) r/w 5(1) (d) Prevention of corruption Act 2006, rigorous imprisonment for a period one year u/s 471 RPC. Court clarified that all the sentences shall run concurrently. (JNF)
