| HC admits writ petition for Granting Rs.25lakh as compensation | | |

Jammu, May 6:-The Jammu and Kashmir High Court (HC) admitted a writ petition, for hearing for grant of Rs.25lakh compensation sought from the power Development Department against the death of 45 year old woman of Solki in Rajouri district due to live broken electricity lines. Admitting the writ petition, Justice Hakim Imtiyaz Hussain directed the secretary PDD and other respondents to file counter affidavit within two weeks.
The writ petition has been filed by Balwant Singh and Munish Singh, both sons of the deceased Staya Devi, through Ashok Sharma, Advocate. According to the petition, the deceased had gone for searching her buffaloes in the nearby forests in Solki on June 28, 2007 where she died because of injury caused to her by naked live broken electric wires. During inquiry it was found that the wires were lying broken for the last 19-20 days and the Lineman of PDD Mohammad Yousuf was requested by the people to affect the repair of these wires but he did not take any action negligently thereby endangering human life. Accordingly, a case under Section 304-A RPC was registered in Police Station, Dharamsal on September 23, 2007 of which the challan was produced before the Judicial Magistrate, Kalakote.
The medical report had specifically mentioned that the cause of death was electric shock leading to cardiac arrest. The respondents, PDD had assured petitioners to provide them compensation and job in the department which was not provided to them despite running from pillar to post, the release added. |
