| Govt teachers banned for private tuitions | | | EARLY TIMES REPORT JAMMU, May 7: Justice Hakim Imtiyaz Hussain has directed the State to strictly implement the order issued on August 11, 2005 that no person engaged with job of teaching in schools and colleges shall undertake any coaching or assignment including teaching in the private institutions or coaching centers without express permission of the government. Any such act would amount to misconduct under the service rules. On a Petition filed by Naresh Gupta in which Advocate SC Subash appeared for the petitioner, Court issued notice to State of J&K through Chief Secretary, Commissioner/Secretary Education Department, Director School Education, CEO and others .It observed that Court have considered the matter and also gone through the rules of Jammu & Kashmir Govt Employee (conduct) Rule 1971 and issued the direction and asked the Government functionaries like Chief Education Officers and Zonal Education officers to strictly enforce these directions and file objections if any with in two weeks. In the petition the petitioner seeking enforcement of Government circular dated August 11, 2005 "which prohibits a Govt servant from taking of any assignment without the permission of the competent authority. Complaints have been moving in from different quarters to the effect that some of the officials of the Education department indulge in coaching in private educational institutions and in so-called coaching centers that too, in certain cases during school hours. It is a serious violation of service conduct rules and warrants action which may include severe penalties like reduction in rank and removal from service. In order to safe-guard the public interest, the academic work in the schools, it is hereby directed no official shall undertake any activity/assignment including teaching in private institutions or coaching center unless permission is obtained from the competent authority to do so. In the circular it is further directed that no such permission shall be available two hours before opening of the school and two hours after the school gets closes. In the circular it is further directed that it shall be responsibilities of CEOs, ZEOs, Principal of Higher Secondary Schools and Head Master of High Schools to look out so that none of the members of the education service (Gazetted or non-Gazetted) indulges in any activity on this account which is in violation of the prescribed code of conduct and instructions". During the course of arguments of Advocate SC Subash who appeared for the petitioner submitted that Government teachers from different schools have started coaching in private institutions/hiring accommodations in the city without having proper permission from the concerned authorities. These teachers even during the school hours attend private institutions for coaching. This affects the study of the regular students. Government has issued above said circular restraining Government officials from unwarranted practice, but inspite of the issuance of the circular, Government teachers have been doing private coaching. As coaching from the Govt teacher continuous and seeking enforcement of the above said circular in letter and spirit. (JNF )
