Court upheld Command's order

EARLY TIMES REPORT
Jammu, May 10: In a petition filed by Munir Hussain seeking quashmnet of order dated August 7, 2004 whereby he had been dismissed from the service by order of commandant BSF on grounds that petitioner has conducted second marriage without obtaining prior permission of competent Authority.
Justice Hakim Imtiyaz Hussain after hearing Adv MI Sherkhan appearing for petitioner whereas Adv Piyush Gupta appeared for Union of India, got through case and arguments of both sides observed that on consideration Court could not find any merit in submissions. It is admitted by petitioner before the concerned Authorities and same has been reiterated by him during arguments before this Court that the petitioner has contracted second marriage with obtaining prior permission from the competent authorities. In these circumstances Court do not find any ground to take a different view from the one taken by commandant while directing dismissal of the petitioner from the service vide order dated August 7, 2004 impugned in the present petition. The petition is accordingly dismissed. ---JNF
