| Petition seeking engagement as daily wager, regularization dismissed | | |
Early Times Report Jammu, May 10: In a petition filed by Talib Hussain and others prayed that state be directed to engage petitioners as daily wagers in terms of scheme and their services be also regularized. Justice Mansoor Ahmed Mir dismissed petition because SRO 64 of 1994 which provides that all those daily wagers who were engaged before January 1, 1995 can seek regularization, provided they have completed seven years service or can claim regularization after completion of seven years. It further provides that no daily wager can be engaged after January 1, 1994. Virtually, said SRO bans & prohibits engagement of daily wager after the said cut-off date. Justice Mansoor Ahmed Mir in approved for reporting judgment observed that petitioners have no right to seek direction from the Court to direct respondents to engage them as daily wagers. Neither this Court has such powers to direct the state to engage them as daily wagers. It is beaten law of land that even a candidate who has participated in the selection process and came to be selected cannot claim appointment of as a matter of right. In the instant case neither selection process was undertaken nor the petitioners are working as such, than how can they claim that the respondents be directed to engage them as Daily Wagers and regularized their services. There is no such law enforce which can be pressed into service for directing the respondents to engage them on daily wager basis. There is no merit in the petition and the same is dismissed. ----JNF
