| Smoking, taking tobacco in public to become tougher | | | Early Times Report Jammu, May 11: In a Public Interest Litigation filed by Jammu & Kashmir Voluntary Health & Development Association seeking directions for effective and meaningful implementation of provisions of cigarettes and other tobacco products (Prohibition of Advertisement & Regulation of Trade & Commerce, Production, Supply and Distribution) Act 2003, Division Bench comprising Justice JP Singh and Justice Ghulam Hasnain Massodi after hearing Advocates Anand Grover and Farhwen Syed Kapra appeared for PIL whereas Additional Advo-cate General J A Kawoosa appeared for State respondents, observed that state counsel had been call upon to immediate steps taken by state government pursuant to issuance of its SROs NOs 394, 239 & 240 under the Act to ensure visible compliance of the provisions of the Act. He is however, unable to convey such instructions. Before proceeding further in the matter, Division Bench would call upon the Chief Secretary of State in the interests of Public Health and in particular health of below 18 years of age to file affidavit within four weeks, indicating the steps, state Govt had taken to make the General Public Aware about the provisions of cigarettes and other tobacco (Prohi-bition of Advertis-ement & Regulation of Trade & Commerce, Production, Supply and Distribution) Act 2003 and to ensure effective implementation of its provisions. Division Bench further directed State Govt to see that display boards, as required under the provisions of the Act and Rules framed, displayed at all public places and more particularly in the educational institutions of the state and directed the registry to list immediately after four weeks. ---JNF
