| Pakistan Answerable for Committing Aggressions & Violations--I | | | A N Bharadwaj
After the partition of British India, the act of acceding of the State Jammu & Kashmir to the Indian Union was a total constitutional, unconditional, irrevocable and absolute. The Instrument of Accession processed by the Ruler was in no way different from the ones executed by over 535-Indian States. Since then, Pakistan has been committing violation after violation on the pretext either this or that way and has not left even for a day to attempt hostile attitude. It has been consistent only in one aspect to treat India its enemy number one, despite granting a status for Muslim Nation in the world by ignoring magnanimity and benevolence showered by India; but its response has been remained negative. It is well known that Pakistan fired the first salvo in 1947, when tribal-led Pak-army invaded of the State Jammu & Kashmir, thereby encroached upon the one third territory of the State at the cost of horrific devastation and human blood and turned habitation in to holocaust. Thereafter, cease fire declared by the UNO in the light of the representation submitted by India regarding devastating aggression and requested to ask Pakistan to stop its further bloody aggression. During pleading it first denied totally and than afterwards accepted of committing aggression shamelessly. Thereafter, it spurned away the UN resolutions , wherein Pakistan was asked to vacate the State territory occupied by it, for the purpose to maintain the status quo, withdraw its forces from the occupied territory of the State, restore the composite character for making the situation clear for plebiscite, Afterwards, failure in to comply with , it fired another salvo and committed further aggression in 1965 and dispatched the well trained Para shooters who started suicide attacks on army, security forces and the people , They started encounters, committed subversive activities, killings, heinous crimes, destabilized the normal life and created lawlessness. However, they were pushed back and suffered heavily. The generous India under Tashkant Agreement surrendered all Pak- pockets captured during war. The wounded Pakistan in retaliation again fired third salvo in revengeful manner in 1971. In that war, it lost the whole cmpact of East Pakistan and instead of this, Bangladesh was emerged on the horizon of political map of the world. This defeat shook the world and Pakistan suffered humiliation internationally. India under the leadership of Indira Gandhi, again, showed generosity under Simla Agreement of 1972, to normalize the mutual relations which proved her gesture of releasing the prisoners of war numbering 93-thousands along with surrendering captured Pak- territory. The cease fire line was altered in to the Line of Control under this agreement so as to root out the cause of conflict. At Simla, India did not treat Pakistan as a defeated country nor did it try to extract a price for the return of PoW and territory, but it was treated in equal position. All the sincere developing affairs of the meting were fully supported and accepted amicably as well as trusted by Zulfikar Ali Bhutto, but Alas! When he went back to his home, he informed to his countrymen that he had signed the Simla Accord in helplessness manner, which encouraged the aggressive elements. It shook not only India but the whole of the world. It was very strange that soon after Accord; he had refuted his own document and spurned the India’s gesture. This was the political character of Pakistan. However, this historical document was also recognized by the UNO that guided to resolve the issue bilaterally with peaceful manner. So much so, the UK secretary of State declared emphatically in the British Parliament in 2002, that dispute between India and Pakistan was at root a bilateral matter which would resolve by direct dialogue between the two parties i.e. India and Pakistan. Under Simla Agreement India provided many concessions and opportunities. Even then Pak- ruling leadership did not give up its hostility. Indian ruling leadership again took initiative and started the campaign of brotherhood and tranquility and undertook a journey for Pakistan to remove the hatred and misunderstandings for mutual peaceful living. It was decided under Lahore Declaration to resolve all pending issues non-violently and peacefully, but this also met with the same fate. At the time when document was being brought out for public information, Pak-forces under clandestine strategy intruded in Kargil heights in Kashmir for occupying the State territory forcibly with might. It confirmed that the nasty mindset that remained consistently hostile against India was correct and not wrong. Apart from it, so many bilateral agreements, Joint Statements and Joint Working group on counter terrorism for restoring peace and other international commitments made against cross border terrorism, to the extend to control the Pak and Pak-controlled soils against terrorism and destroy terror establishments against India declared in assertive manner but those promises and commitments did not match in to action, which lowered its reputation and image on international level. Those all deceitful and false assertions proved hallow and misguiding. In the light of this, Pakistan proved of not being a responsible and trustworthy country. No doubt, Kashmir is used as ploy by these Pak-ruling leaders and extremists for gaining popularity, retaining political power and establishing hegemony at the cost of people Interest. The Pak-ISI not only foments terrorism in Kashmir but it fuelled in Punjab also along with North-eastern and Southern States. Pakistan should know that India made a supreme sacrifice at the cost of its majority people by granting them an identity as a Nation for Muslims in the world for ever lasting peace by dividing its country for their Home-land as demanded by M A Jinnah, founder of Pakistan, hence they should be thankful; but it implied clearly that if Kashmir issue is settled on its terms and conditions, even then its hostility would not come to end, it is its political character. Kashmir is a business for Pak-tutored lobby working in the valley. It should know that its desired self-styled aim would not be achieved by misleading the people. The weapon used by it to provoke the sentiments in the name of religion, deliver fiery and inflammatory speeches for inciting communally against its nation would not bring healthy results. The UN resolutions and plebiscite for which they are harping on have become redundant. It has been removed those out dated proposals from the list of its agenda once for all. This time barred issue has lost its all reference in tote. It cannot be kept alive for ever. This was also informed by Pt. Jawaharlal Nehru that the plebiscite was the conditional and not for ever. Those UN resolutions now have no status for any review. Pakistan has failed to comply with the resolutions as stipulated that it would vacate the territory of the State occupied by committing aggression, withdrawing its forces and restore status quo and peace as existed before Pak-tribal invasion in 1947; but Pakistan did not fulfill its directions. In this regard the statement of the former UN Secretary General Kofi Annan is a guide line for those, who harp on for plebiscite. He declared that Simla Agreement and Lahore Declaration for Kashmir issue must be considered valid. His statement would instill a great sense of realism in Pakistan and the anti-national parties working in the valley on the behest of Pakistan to adopt a more positive attitude in their negotiations with Indian ruling leadership on the merit basis. Earlier it was clarified already by Gunnar Jarring, UN Representative for Jammu & Kashmir, on 29th April 1957, who said that “I could not fail to take note the concern expressed in connection with the changing political, economic and strategic factors surrounding the whole of Kashmir question, together with the changing patterns of power relating in the west and South Asia. The Council will further more aware of the fact that implementation of international agreement of an adhoc character, which has not been achieved fairly may become progressively more difficult because the situation with which they were to coup has tended to change”. Other violation committed by Pakistan was that it included the northern part of the occupied State Gilgit Agency comprising of Baltistan and Skardu etc. in its country as a one of its parts. The Pak-ruling leaders invited tribal Afridi people from Swat valley and other areas of FATA belonging to other sects and settled them there in order to effect demographic change in spite of the protests and agitations of the people and made the hub of terrorists to generate Islamic terrorism. There had been massive demonstrations against the settlement of those aliens on their land. The Pak-Government instead of paying heed to their demand in democratic manner, it retaliated and committed brutal repression against them through bullet showers. There nationalist leadership had been detained several times and put behind the bars. It made gigantic constructions on its own on the occupied State territory, which were the serious violations in changing the status quo. It lost its credit and all rights to press for any demand in the light of violation and after violation. Apart from it, it has destroyed democracy and consistently tempered with electoral system and now is misleading the people in the name of religion on self-created Kashmir issue and started terrorism to garb the State by bleeding. On the other side, on what basis the Pak-ruling leadership ask India to give the right of self determination to the people of the State in the incited atmosphere of religion after flowing the much water from the rivers of Tawi and Jehlam. Even then in lunatic manner, it harps on for out dated conditional plebiscite in Kashmir on its terms which is absurd. The partition of British India and the accession of the J&K State to India under Indian Independence Act cannot be altered. The Hindu-Muslim question now cannot be raised, while the Home-land for Muslims has been granted by the indigenous people of British India for ever lasting peace. The Indian Muslims enjoy every right very proudly more than the Hindus in the secular democracy of India under the provision of reservations and quotas, but in Pakistan the people are reeling in toothless democracy. The dreaming proposal forwarded by the Pak-ruling leadership un-warranted for Indian Muslims of J&K State in the capacity of guardian of Muslims, it should first be applied for the people of the provinces as mentioned above. It is well known that Pakistan is that country where the people belonging to other faith of community are slaughtered, minorities behaved humiliatingly, dwindled and eliminated as well as the muhajreen migrated from UP and Bihar and opted Pakistan during the partition of British India have not been assimilated as yet in its nation and are treated as untouchables and inferiors. Pakistan is a hub of sectarian violence and brutal killings. Sectarian conflicts and clashes, intolerance and blood shed to establish sect wise hegemony are the routine features that wickedness, evilness and extremism have divided the nation in to many segments. In the light of this, Pakistan is an irresponsible nation and failure state. Apart from this, it has disturbed territorial status quo and violated Nehru-Liyaqat Pact, Simla Agreement, Lahore Declaration, Blair-Mush Joint Statement and Commitment of No Use of its and its controlled soils for Terrorism and non-matching its words in to action as well as non-sticking in its international commitments; therefore its leadership is not reliable.
