Court directs CB to arrest accused in alleged murder of NC leader

Jammu, May 13: In much publicized murder case of Ghulam Mohd Rather, NC leader, childhood friend of Ghulam Nabi Azad, Crime Branch presented challan u/s 302/341/201/34 RPC in FIR No 22/2007 registered with P/S Gandoh against six accused persons namely Natha Singh, Jaswant Singh, Sunil Kumar, Faqir Mohd, Shair Ali and Mohd Ishaq, challan was presented by Fareed Hussain Head Constable NO 241/CR of Crime Branch Jammu against above said accused persons in absence of accused persons before the Court of Munsiff Gandoh (Bhallesa) with prayer for initiating proceedings u/s 512 CrPC against accused persons. According to the Crime Branch accused persons have absconded after commission of offence, Crime Branch has searched accused persons but has not been found anywhere and it is difficult to procure attendance of accused persons in Court. Statement of Constable Rakesh Kumar has been recorded and statement of Chowkidar Halqa Kilhotrian, Ghulam Rasool Rather who is cousin of deceased Ghulam Mohd Rather himself appeared before Court has also and placed on record for satisfaction of this Court. Munsiff Magistrate Gandoh (Bhallesa) Bashir Ahmed Munshi observed that it is not out of place to mention here that accused persons namely Natha Singh and Shair Ali who have been bailed out by this Court have filed an application before this Court on March 31, 2010 for permission to leave territorial jurisdictions which was allowed and accused persons were permitted to leave Doda District for five days. Therefore, how it can be believed that accused persons absconders and are not traceable. Crime Branch has not made the real efforts for arrest of accused persons. The statement of IO could not be recorded due to his absence. With these observations Court returned challan with direction to make real efforts for arrest of accused persons. ---JNF
