Full Court issues guidelines for transfer of judicial officers

Jammu, May 19: In a full Court meeting held with the Chief Justice Jammu & Kashmir High Court Dr. Aftab Hussain Saikia in chair today at Srinagar guidelines for transfer of judicial officers were laid down.
The meeting decided that unless otherwise directed by the Chief Justice, the general transfers of the judicial officers in the state shall be effected twice in year in the months of April/May and October/November; As far as practicable, Principal Sessions Judges shall not be posted in their home districts. Similarly a judicial officer shall not be posted in any district where his close relative is practicing in the courts; as far as practicable a judicial officer may not be posted as a placed before expiry of two terms of posting at other places; A Judicial Officer may, normally be transferred on expiry of two years of posting at a particular place, but if an exigency arises, he may be transferred before that period.
The Registrar General will obtain in advance three choices of places of posting from the concerned judicial officers who are due for transfer and shall place the same before the committee of transfer; As far as practicable, such choices may be honoured while effecting the transfers. There will, however, be no assurance on that count. No Judicial Officer May be posted at Leh, Kargil, Gurez, tehsil Headquarter of Tangdhar in Kashmir province and Gool Gulabgarh, Gandoh, Bhalessa, Bani and Mahore in Jammu province for a period in excess of one year and may not be posted from one of those places to another such location on transfer. Further a Judical Officer serving in above said locations for a period of one year may not be posted to any such location until expiry of five years from the last posting at any such locations.
