| HC dismisses review petition | | | EARLY TIMES REPORT Jammu, May 28 : A Division Bench of Jammu Kashmir High Court, Jammu Wing, comprising Chief Justice Dr Aftab H Saikia and Justice Sunil Hali dismissed a review petition challenging appointment of a Anganwari worker. The court after hearing the parties found no error on the face of the record to warrant interference in the impugned judgement on the review and accordingly dismissed the petition. "The appellant has failed to put forward any sufficient grounds as required to be looked into by the review court for review of the impugned judgment", the court held. In the review petition, the petitioner Kamlesh Kumari sought review of the judgment passed in LPA dated February 21, 2009 where in the judgment and order dated April 4, 2008 passed by the writ court was challenged on the private respondent did not belong to the village where deficiency/ vacancy existed. The LPA under review was dismissed holding that both the appellant and the respondent belonged to one and the same village where vacancy was available and merit wise also admittedly the appellant trailed which was not disputed before the appellate Court. The judgment written by Chief Justice Dr Aftab H Saikia for the Division observed that from the arguments placed on record by the counsel for the appellant, it appears that basically an attempt has been made to bring a new issue before this Court which was not agitated before the writ Court. Primarily the appellant has sought for review of the judgment in question on various grounds and dismissed the same. ---JNF
