FCI carriage contract

EARLY TIMES REPORT
JAMMU, Jun 1: The high court today ordered release of amount deposited with the Registry to Food Corporation of India (FCI). A division bench comprising Chief Justice Dr Aftab Saikia and Justice JP Singh issued the orders in two CMPs modified by the interim order dated May 10, 2010.
An appeal filed by M/S Shivam Enterprises seeking setting-aside the judgment of Single Judge whereby his petition had been dismissed by the single bench. The court after hearing the parties modified the interim order whereby the FCI had been ordered to deposit 50% of the security amount as security with the registry of the high court. The amount so deposited shall be kept in the form of fix deposit initially for a period of six months. On the deposit of the amount by the FCI, the amount already deposited with the Registry in terms of the interim order shall be released in favour of the FCI. The court further observed that the contract allotted to the private respondents shall remain subject to the outcome of this LPA. The CMPs were accordingly disposed off. ---JNF
