| Murder accused can attend mundan ceremony of his son | | | EARLY TIMES REPORT JAMMU, June 3: The 2nd Additional Sessions Judge Jammu VC Koul today rejected the bail application of an accused facing charges of murdering the former deputy Advocate general of the state. The accused Vishal Sharma is facing charges of murdering the then Deputy Advocate General Ajit Dogra. The bail application filed on ground that the participation of the accused in the Mundan ceremony of his son was necessary. The Special Public Prosecutor Advocate RK Kotwal objected the bail application on the ground that the applicant/accused was charged of an offense punishable with death or imprisonment for life and there is very likelihood of his jumping over the bail and tempering with the evidence if released for a limited period. The court after considering the arguments of both the sides observed that no ground for interim bail had been made by the petitioner/accused and as such the prayer for interim bail is rejected. However, keeping in view the alternative submission of the accused that accused being the father and his presence in the function is essential for the performance of mundan ceremony and in view of submissions of Special PP that in case he be permitted to attend such ceremonies in proper custody, he has no objection, Upon this Court directed Supt District Jail Jammu, that he shall take accused Vishal Sharma to place of mundan in custody under proper and adequate police escort on June 4, 2010 from 10:00 AM and take him back to the jail at 6:00 PM and on June 6, 2010 from 6:00 PM and lodged back in the jail on June 7, 2010 at 7:00 AM, Court also directed SSP Jammu to provide proper escort for the purpose. It is further made clear by the Court that escort officer does not allow the accused to intimidate the witnesses during his visit to the mundane site. -- (JNF)
